EAGLE Health & Wellness "Find Scout" Monthly Contest Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

1. Sponsor: The Contest is sponsored by EAGLE Health & Wellness, located at P.O. Box 958, Pt. Pleasant, NJ 08742 ("Sponsor").

 

2. Eligibility: The EAGLE Health & Wellness "Find Scout" Monthly Contest (the "Contest") is open only to legal residents of the state of New Jersey who are eighteen (18) years of age or older at the time of entry. Employees, officers, directors, and agents of Sponsor, its affiliates, advertising and promotion agencies, and their immediate family members (spouse, parents, siblings, children, and their spouses) and/or those living in the same household of each are not eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

 

3. Agreement to Official Rules: Participation in the Contest constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.

 

4. Contest Period: Each monthly Contest begins upon the first distribution of the newsletter for that month containing the "Scout" advertisement and ends when entries must be received, as specified in the newsletter (the "Deadline"). Sponsor's computer is the official time-keeping device for the Contest.

 

5. How to Enter: There is one (1) method of entry:

Mail-In Entry: Legibly complete the official entry form from the EAGLE Health & Wellness newsletter. You must include the original, physical newsletter advertisement featuring "Scout" (no photocopies, digital prints, or reproductions accepted). Mail the completed entry form and the original qualifying ad in an envelope with sufficient postage to:

Entries must be received by the Sponsor by the Deadline published in the newsletter. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, illegible, or misdirected entries, which will be disqualified. Proof of mailing does not constitute proof of delivery.

 

6. Entry Limits: One (1) entry per household, per monthly Contest period, regardless of method of entry. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins, or any other methods will void that entrant's entries and that entrant may be disqualified at Sponsor's sole discretion.

 

7. Prize Drawing and Winner Notification: On or about the 5th of the month following the Contest Period, the Sponsor will select one (1) potential winner in a random drawing from among all eligible entries received. The odds of winning depend on the number of eligible entries received. The potential winner will be contacted by phone using the number provided on the entry form on or about the next business day following the drawing. If a potential winner cannot be contacted, is ineligible, fails to claim the prize within five (5) days of the first attempt to contact, or fails to timely return any required documents, the prize may be forfeited and an alternate winner selected by random drawing from the remaining eligible entries.

 

8. Prize: One (1) monthly prize will be awarded: A check in the amount of Fifty US Dollars ($50.00). The prize is non-transferable, non-assignable, and no substitution or cash equivalent is permitted except at the Sponsor's sole discretion. The Sponsor reserves the right to substitute a prize of equal or greater value if the advertised prize becomes unavailable. The winner is solely responsible for all federal, state, and local taxes and any other costs, fees, and expenses not explicitly listed herein.

 

9. General Conditions: Sponsor reserves the right to cancel, suspend, and/or modify the Contest, or any part of it, if any fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

10. Release and Limitations of Liability: By participating, entrants agree to release, indemnify, defend, and hold harmless the Sponsor, its affiliates, and their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Contest or receipt or use/misuse of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest; (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of entries; or (f) injury or damage to persons or property. Entrant waives the right to claim any attorneys' fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

 

11. Disputes: Except where prohibited, entrant agrees that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate state or federal court located in Ocean County, New Jersey; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys' fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules.

 

12. Winner's Name: For the name of the winner (available after the 10th of each month), send a self-addressed, stamped envelope to: EAGLE Health and Wellness, Winner List, P.O. Box 958, Pt. Pleasant, NJ 08742. Requests must be received by the 30th of that month.
